SMS Messaging Terms & Compliance

1. Program Description

GT Power Construction Inc. (“GT Power,” “Company,” “we,” “us,” or “our”) offers an SMS messaging program for customers and individuals who have explicitly opted in to receive text messages from us.

SMS consent may be collected through our website, including forms that contain a dedicated checkbox or other clear mechanism for providing SMS consent. By selecting the SMS consent option and submitting your information, you agree to receive text messages from GT Power at the mobile number you provide.

Messages may include:

  • Solar quote-related communications
  • Project status updates
  • Appointment confirmations and reminders
  • Appointment scheduling or rescheduling updates
  • Customer support communications
  • Service-related updates
  • Other conversational or transactional messages directly related to services you have requested

Consent to receive SMS messages is not a condition of purchasing goods or services.

2. Cancellation / Opt-Out Instructions

You can cancel SMS communications at any time by replying “STOP” to any message from us.

After receiving your STOP request, we will send a confirmation message and will not send further SMS messages unless you subsequently provide consent to receive them again.

To resume receiving SMS messages, you may re-opt in through our website or another available opt-in method.

4. Message & Data Rates

Message frequency may vary based on your interactions with GT Power, your service requests, project status, and appointment schedule. Under typical circumstances, you may receive approximately 10 SMS messages per week, although actual frequency may vary.

5. Carrier Liability

Wireless carriers are not liable for delayed or undelivered messages.

Our SMS program is intended to work with major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

6. SMS Consent and Data Protection

GT Power does not sell, rent, or share mobile phone numbers or SMS opt-in information with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent records are kept confidential and are not shared with third parties for purposes unrelated to providing our direct services.

We may use SMS service providers, aggregators, or subcontractors as necessary to provide customer communications and deliver text messages that you have expressly consented to receive. Such providers may process information solely in connection with providing those services.

Your SMS opt-in information and consent will not be used or disclosed for unrelated marketing or promotional purposes.

Other Users

To the extent the Site permits users to submit or post content, each user is solely responsible for their own User Content.

GT Power does not control User Content submitted by users and is not responsible for such content.

GT Power is not responsible for losses or damages resulting from interactions between users or from reliance on User Content.

Your access to and use of the Site is at your own discretion and risk. You are solely responsible for any damage to your device or computer system or loss of data resulting from your use of the Site.

To the maximum extent permitted by law, GT Power’s aggregate liability for damages arising out of or relating to these Terms or your use of the Site shall be limited to US $50.00.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

Online Commerce

Certain sections of the Site may allow you to request or purchase products or services.

Where third-party vendors are involved, GT Power is not responsible for the quality, accuracy, timeliness, reliability, or other aspects of products or services provided by such third parties.

If you make a purchase or enter into a transaction with a third-party vendor through or in connection with the Site, the transaction is solely between you and the third party.

GT Power will not be responsible for losses or damages resulting from dealings between you and third-party vendors, to the extent permitted by applicable law.

Registration & Passwords

Certain features of the Site may require you to register or create an account.

You agree to provide accurate, current, and complete information when registering and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

If you suspect unauthorized use of your account, notify GT Power immediately at info@gts-power.com.

GT Power is not responsible for losses or damages arising from your failure to maintain the security of your account credentials.

Termination

GT Power may suspend or terminate your access to the Site at any time, with or without notice, if GT Power determines that you have violated these Terms or engaged in conduct that is inappropriate, unlawful, or harmful to the Site or others.

Upon termination, you must cease all use of the Site and any content obtained from it.

GT Power will not be liable to you for termination of your access to the Site.

Provisions that by their nature should survive termination, including intellectual property rights, disclaimers, limitations of liability, indemnification, dispute resolution, and other applicable provisions, will survive termination.

Copyright Policy

GT Power Construction Inc. respects the intellectual property rights of others.

If you believe that material appearing on the Site infringes your copyright, you may provide GT Power with a written notification containing:

  • Identification of the copyrighted work that you claim has been infringed.

By using the Site or providing your contact information, you consent to receive electronic communications from GT Power where applicable.

You agree that electronic communications, notices, disclosures, agreements, and other communications provided electronically satisfy any legal requirement that such communications be provided in writing, to the extent permitted by law.

SMS communications are subject to the SMS Messaging Terms & Compliance section above.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising under these Terms shall be handled in accordance with the dispute-resolution and arbitration provisions below.

Dispute Resolution & Arbitration

Informal Resolution

Before initiating arbitration, you and GT Power agree to attempt to resolve any dispute informally.

A written Notice of Dispute to GT Power should be sent to:

The notice should describe the nature and basis of the dispute and the requested relief.

The parties will have 30 days after receipt of the Notice of Dispute to attempt to resolve the matter informally.

Binding Individual Arbitration

If a dispute cannot be resolved informally or through a small claims court action, the dispute shall be resolved through binding arbitration on an individual basis, subject to applicable law and the terms of this arbitration agreement.

Arbitration shall be administered by the American Arbitration Association (“AAA”) unless the parties agree otherwise.

The arbitration shall be conducted by a single neutral arbitrator.

Unless otherwise required by applicable law or agreed by the parties, arbitration proceedings will be conducted in English.

No Class Actions

To the fullest extent permitted by applicable law, disputes must be brought on an individual basis and may not be brought as a class action, collective action, or representative action.

Claims involving more than one customer or user may not be consolidated or arbitrated jointly unless all parties expressly agree otherwise.

Small Claims Court

Notwithstanding the arbitration provisions above, either you or GT Power may bring an individual claim in small claims court where permitted by applicable law.

Waiver of Jury Trial

To the extent a dispute is permitted to proceed in court, you and GT Power waive the right to a jury trial to the fullest extent permitted by applicable law.

Severability

If any portion of this arbitration agreement is found to be invalid or unenforceable, that portion will be severed or modified to the minimum extent necessary, and the remaining provisions will remain in effect.

The arbitration agreement will survive termination of your relationship with GT Power.

Export Compliance

The Site and certain technical information provided through the Site may be subject to United States export-control laws and regulations.

You agree not to export, re-export, or transfer information or products obtained through GT Power in violation of applicable United States laws or regulations.

For significant changes, GT Power may provide notice by email or through a prominent notice on the Site where appropriate.

Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into the Site, constitute the entire agreement between you and GT Power regarding your use of the Site, except where a separate written agreement governs a particular product or service.

GT Power’s failure to enforce any provision of these Terms does not constitute a waiver of that provision.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable to the extent permitted by law.
